Cedar Rapids Court Case
Tara - I still feel very torn about this case. I can see the argument on both sides, and I feel like it is really difficult to say which is right. One the one hand, the school district really is responsible for the free and appropriate education of many students, and devoting so many resources for just one student may have a negative effect on the other students. However, Garret needs to have those services provided in order to attend school and by law he is entitled to a free and appropriate public education (for which a full-time nurse is a necessity). Honestly I do not feel like it should be the responsibility of the school district or the parents to provide the service Garret needs. Since the accident caused a life-long issue I believe the insurance payout should also be life-long. Either that or the government should provide extra funding for the schools that have students that require such intense care since it is a federal law that requires the school districts to provide the extra service then the extra funding required should be federally provided.

While studying this case I keep going back and forth on which side I agree with. As a teacher I see how the school district feels like it is not their duty to provide Garret with a full time nurse. This is a service that they don't provide to all their students and is very expensive. As was mentioned in class, if this is a small school district then it could be their whole budget. This makes it unable for the school district to provide their other students with services they need. As a future parent I see the side of the parents. Their child deserves a free and appropriate education and in Garret's case this means he needs a full time nurse in order to attend school. The school should pay for this, just as they pay for services other students require. If i have to pick a side I agree with the parents because, under the law Garret deserves a free and appropriate education which for him requires a full time nurse.
ReplyDeleteLinzie: I feel that it is the school district's responsibility to provide Garret with free and appropriate education, thus I would side with the parents. Garret has so much potential in his future because he is able to learn at the same rate as other typical developing children. His physical impairments should not stop him from being able to get an appropriate education. I feel that the school district should find him a nurse because it would only be needed for in the classroom and it would be difficult for the parents to go to all of that hassle when they wouldn't need the nurse at home and they already have so many other difficult things they must be going through with Garret. It is his right to receive a free and appropriate education from the school district and although it would be difficult for them, it is something that is necessary for him.
ReplyDeleteHi! Where's Linzie's comment? I can't find it. I'm still trying to figure out how to navigate this. So, before class on Thursday I actually thought I was on the side of the school. But after class I think I will pick the parents. Although, I do feel like both sides have very valid points. Here is my short and sweet input. If the supreme court is going to rule in several court cases that everyone has the right to a free public education and make that a law, then they should be working together with the schools to actually make that possible for ALL children with ALL disabilities. They're the ones that ruled it. It's a matter of sticking to your word. Unless by "everyone" you didn't actually mean "everyone."
